I grew up in a family that always seemed to have money challenges, especially after my parents divorced when I was very young. They tried incredibly hard, but I knew, even as a small child, that it was rough on them.

That led me to a career in finance as I wanted to learn and understand how to better support myself and my future family.

After going through an incredibly difficult divorce myself, I decided to become a Certified Divorce Financial Analyst® and founded Allegiant Divorce Solutions to help others better prepare for, navigate, and recover financially from divorce. I promised myself early on that I would do whatever was required to ensure that my clients never felt the same struggles related to money that I did growing up and through my divorce.

With almost 20 years of experience, I really love helping clients make important financial decisions and making the puzzle pieces ‘fit’ for them, especially amid divorce.

Splitting retirement accounts in divorce is one thing. Taking the money out is another.
A 50/50 division might seem straightforward, but what happens to those funds afterward can make a big difference in how much money you actually keep.
For example, withdrawing money from a 401(k) or traditional IRA could trigger income taxes and, depending on your age and circumstances, an early withdrawal penalty.
And not every retirement account follows the same rules.
A 401(k) may require a Qualified Domestic Relations Order (QDRO) to divide the account as part of a divorce. IRAs follow a different process, while Roth accounts have their own tax considerations.
That's why it's important to understand the difference between transferring retirement funds and cashing them out.
A retirement division that looks equal on paper could leave one person with much less after taxes.

Cashing Out Retirement During Divorce Could Cost You

Two divorce settlement options might look equal on paper, but are the account balances being compared from the same date?
It's a detail that can easily get overlooked.
A retirement account might reflect its value from December, while a savings account shows a more recent balance. Meanwhile, the credit card debt could be based on a statement from three months ago.
Put those numbers together, and the financial picture may not be as accurate as it appears.
Think about what could have changed between those dates.
Retirement investments may have gained or lost value. Money could have been withdrawn from savings. Credit card balances may have increased or decreased.
Even small changes across multiple accounts can affect how two settlement options compare.
That's why checking the valuation dates matters just as much as reviewing the balances themselves.

Why Financial Dates Matter in Divorce

A large or unexpected transaction during divorce can raise questions, but it does not automatically mean something improper happened.
That transfer could be connected to taxes, debt payments, tuition, a business expense, or another legitimate cost.
What matters is whether the transaction can be explained and supported by the records.
If documents are missing, the amount does not line up with the explanation, or similar transactions keep appearing, it may be worth looking further.
One unusual entry alone usually does not tell the full story. The surrounding records, timing, explanations, and any larger pattern can provide important context.
When more detailed tracing or investigation is necessary, a forensic accountant and attorney may need to become involved.
Before jumping to conclusions, start with what can be documented, identify what is missing, and determine whether the concern warrants a deeper financial review.
